Summary
This is a project primarily of "law in action".
Based on the framework laid down in the Digital Services Regulation and within the scope of regulatory administrative law, the aim is to study the establishment of a new regulator provided for in that Regulation, analysing i) the legal issues arising from such establishment, such as the legal model of funding, organisation and functioning, and ii) the first regulatory measures adopted to ensure compliance with the DSR in Portugal.
Objectives
1. To study the establishment of a digital regulator, with regard to issues of administrative organisation and the setting-up of a regulatory model, both in terms of funding and structure;
2. To understand how the DSR is applied through seminal regulatory intervention;
3. To identify the difficulties in the regulatory application of the DSR, distinguishing between difficulties originating from the Portuguese Public Administration itself and those arising from the regime deriving from the DSR.
Relevance
The proposal is considered relevant due to the innovative nature of the study, not only as an expression of an analysis of "law in action", but also because it is carried out in a digital law context with a strong impact on people’s everyday lives, given that the DSR is directed at the functioning of social networks and digital marketplaces.
