Summary
The project examines the impact of artificial intelligence and large language models on Public Administration, with a particular focus on administrative decision-making.
At a time when the digitalisation of public services has advanced significantly, the project seeks to explore the legal challenges posed by the algorithmic automation of administrative decisions, contributing to the development of research in Administrative Law and to the broader debate on adapting the legal framework to these emerging technologies.
Objectives
- - Examine the use of artificial intelligence in administrative decision-making.
- - Analyse the legal admissibility of algorithmic administrative decisions, including those adopted within the scope of administrative discretion.
- - Identify the legal framework applicable to administrative decisions supported by artificial intelligence, as well as issues relating to liability for damage caused.
- - Investigate the role of human oversight and the concept of a humanity safeguard in the use of artificial intelligence systems by Public Administration.
- - Promote national and international academic debate on these issues.
- - Produce research capable of supporting future legislative developments.
Relevance
Artificial intelligence represents the next stage in the digital transformation of Public Administration, offering significant opportunities to improve the efficiency, speed and quality of public services.
At the same time, its use raises fundamental legal challenges relating to legality, transparency, accountability and the protection of citizens' rights.
In Portugal, this remains an underexplored area of legal research, with no dedicated legislative framework currently in place. By bringing together national and international experts, the project aims to contribute to the development of legal solutions capable of addressing these technological challenges, strengthening academic debate and supporting future public policy and legislative reform.
