Rising sea levels generate flooding in coastal areas, particularly affecting low-lying coastal states at risk of extinction due to the submersion of their territory. The legal consequences arising from the disappearance of a State's terrestrial territory due to natural causes are uncertain from an international legal point of view as it is an unprecedented issue that calls into question the notion of territoriality as a foundation and attribute of the Westphalian State. This investigation aims to problematise the principle of territorial integrity in light of the climatic challenges posed to the territory of States and answer the question of whether States in the process of disappearing will be able to maintain the status of State if they no longer comply with the territorial criterion referred to in the Montevideo Convention and, if they are extinguished, what legal solutions are outlined.
