Regime jurídico-internacional para o enquadramento da subida do nível do mar

The creation of an international legal regime to address sea level rise is an excellent example of the relevance of International Law and its progressive development. This is an issue that has only recently begun to be considered by international law scholars in terms of academic debate and where international practice is, simultaneously, an inducer of doctrinal reflection and the result of doctrinal contributions that have been produced over the last three decades. Awareness of the existence of international legal issues caused by sea level rise has led to the various matters related to this topic beginning to be the object of analysis and research by international law scholars, with emphasis on the results of the reflections of two committees of the International Law Association, and of an intergovernmental discussion based on the work being developed on the topic within the scope of the International Law Commission of the United Nations. Among the various international legal issues related to sea level rise, this text gives particular attention to two matters: on the one hand, the discussion on the preservation or the ambulatory nature of baselines as a result of changes in the land territory of the coastal State caused by sea level rise and, on the other hand, the debate on the need to create a specific international legal regime for the forced movement of people caused by sea level rise.
