The “right to (a healthy) environment” in the context of International Law is widely regarded as first appearing in Article 1 of the Stockholm Declaration, according to international legal scholarship. Since then, this right has proliferated across various legal instruments, including national constitutions (the Portuguese Constitution being one notable example: see Article 66, paragraph 1) and some Charters of Rights.
