Considerando que a proporcionalidade tamb\u00e9m define as condi\u00e7\u00f5es para uma preval\u00eancia entre normas dentro de uma pondera\u00e7\u00e3o, especificamente atrav\u00e9s das duas leis de pondera\u00e7\u00e3o, o artigo contrap\u00f5e os esquemas de pondera\u00e7\u00e3o com uma norma que confere uma liberdade e com uma norma que confere um direito social. As principais alega\u00e7\u00f5es subjacentes a essa contraposi\u00e7\u00e3o s\u00e3o que ambos os esquemas de compensa\u00e7\u00e3o exigem testes de proporcionalidade sequenciais semelhantes e que a proporcionalidade \u00e9 aplic\u00e1vel da mesma forma.
