Embora seja do conhecimento geral que as democracias liberais exigem a divis\u00e3o tripartida de poderes, o papel dos ju\u00edzes e os desafios que o seu trabalho apresenta na perspectiva de garantir a imparcialidade, independ\u00eancia e responsabiliza\u00e7\u00e3o judiciais t\u00eam sido raramente explorados e recentemente tamb\u00e9m amea\u00e7ados. Podemos observar s\u00e9rios ind\u00edcios de que estamos a testemunhar o in\u00edcio de uma luta mais longa por padr\u00f5es de julgamento justo consagrados na Carta dos Direitos Fundamentais (CFR). Este Projeto visa auxiliar na resposta \u00e0 atual crise constitucional. As normas consagradas no QCR e, em particular, no artigo 47.\u00ba sobre o direito a um recurso efetivo e a um julgamento justo fazem parte de um quadro jur\u00eddico mais amplo a n\u00edvel da UE que garante a independ\u00eancia, a imparcialidade e a responsabiliza\u00e7\u00e3o dos ju\u00edzes e dos \u00e1rbitros e outros profissionais do direito. Al\u00e9m disso, aumentar a capacidade dos profissionais da justi\u00e7a, incluindo o poder judicial, para promoverem o Estado de direito no seu trabalho quotidiano, ao mesmo tempo que implementam o quadro jur\u00eddico dos direitos fundamentais da UE. Ao faz\u00ea-lo, o Projecto visa apoiar o desenvolvimento de redes de profissionais da justi\u00e7a com conhecimento que trabalham no Estado de direito e na democracia. Esta se\u00e7\u00e3o descreve o contexto dos problemas, as necessidades e os objetivos abordados pelo Projeto.","objectivos-do-projeto":"O Projecto envolver-se-\u00e1, atrav\u00e9s de uma intensa actividade de apura\u00e7\u00e3o de factos, na identifica\u00e7\u00e3o de crit\u00e9rios fi\u00e1veis para estabelecer se um tribunal nacional e \u00e1rbitros podem fornecer, num caso individual, uma solu\u00e7\u00e3o eficaz e um julgamento justo na acep\u00e7\u00e3o do art. 47 CFR. Ser\u00e1 dada aten\u00e7\u00e3o aos conceitos de \u201cindepend\u00eancia\u201d, \u201cimparcialidade\u201d e \u201cresponsabilidade\u201d, que ser\u00e3o tratados como conceitos distintos, mas estritamente ligados, onde cada um dos tr\u00eas tem influ\u00eancia sobre os outros e os tr\u00eas s\u00e3o essenciais objectivo de implementar uma protec\u00e7\u00e3o judicial eficaz. Os crit\u00e9rios e ferramentas identificados servir\u00e3o ent\u00e3o de base para sess\u00f5es de forma\u00e7\u00e3o transnacionais e transfronteiri\u00e7as e para a forma\u00e7\u00e3o nacional. A aquisi\u00e7\u00e3o de conhecimentos pelas profiss\u00f5es jur\u00eddicas sobre as normas do CFR em mat\u00e9ria de independ\u00eancia, imparcialidade e responsabiliza\u00e7\u00e3o ser\u00e1 assegurada pelo Projecto, nomeadamente: - sensibilizando os tribunais nacionais, \u00e1rbitros, advogados, procuradores e outros funcion\u00e1rios p\u00fablicos para o papel do direito da UE e o QCR como meio de contrariar desafios (ou viola\u00e7\u00f5es) do Estado de direito europeu; - dotar os tribunais nacionais, os \u00e1rbitros, os advogados, os procuradores e outros funcion\u00e1rios p\u00fablicos de crit\u00e9rios objetivos destinados a avaliar a independ\u00eancia, a imparcialidade e a responsabiliza\u00e7\u00e3o judicial (sua pr\u00f3pria e dos seus pares no mesmo Estado-Membro ou noutro Estado-Membro); - familiarizar os tribunais, \u00e1rbitros e advogados nacionais com as t\u00e9cnicas de interac\u00e7\u00e3o judicial e, mais genericamente, de interac\u00e7\u00e3o jur\u00eddica e de di\u00e1logo judicial, atrav\u00e9s das quais possam testar a conformidade formal dos Estados-Membros com os crit\u00e9rios acima mencionados e, consequentemente, demonstrar o potencial do QCR como uma ferramenta eficaz para abordar a independ\u00eancia, a imparcialidade e a responsabiliza\u00e7\u00e3o dos ju\u00edzes e \u00e1rbitros - promovendo a liberdade de express\u00e3o do poder judicial na sua capacidade profissional, incluindo a sua rela\u00e7\u00e3o com os meios de comunica\u00e7\u00e3o social e a utiliza\u00e7\u00e3o de tecnologias, o que, em \u00faltima an\u00e1lise, dever\u00e1 melhorar a confian\u00e7a do p\u00fablico na administra\u00e7\u00e3o eficaz e correcta da justi\u00e7a. A equipa garantir\u00e1 que este projecto n\u00e3o duplicar\u00e1 nenhum projecto anteriormente financiado pela CE sobre forma\u00e7\u00e3o para profissionais da justi\u00e7a em \u00e1reas semelhantes. Embora o Projecto trate de um tema que j\u00e1 foi abordado anteriormente por outras institui\u00e7\u00f5es de forma\u00e7\u00e3o \u2013 a independ\u00eancia judicial, este Projecto centra-se no valor acrescentado da Carta da UE na salvaguarda da independ\u00eancia judicial. Isto significa que a sua prote\u00e7\u00e3o exige elevados n\u00edveis de conhecimento dos componentes substantivos das normas em causa. Al\u00e9m disso, s\u00e3o necess\u00e1rios mecanismos processuais, tanto a n\u00edvel nacional como internacional, para\r\npromover esses padr\u00f5es. Portanto, a TRIIAL prev\u00ea a colabora\u00e7\u00e3o estreita e interprofissional\r\nforma\u00e7\u00f5es predominantemente a n\u00edvel transnacional para melhorar o conhecimento de todos os profissionais jur\u00eddicos sobre o assunto.\r\nEm linha com a experi\u00eancia consolidada do Requerente e dos Parceiros do Cons\u00f3rcio no dom\u00ednio da forma\u00e7\u00e3o jur\u00eddica, o TRIIAL aborda a prioridade de apoiar a forma\u00e7\u00e3o judicial de profissionais da justi\u00e7a, com a esperan\u00e7a de que o projecto ajude a construir a confian\u00e7a do p\u00fablico na profiss\u00e3o de ju\u00edzes para sustentar sua posi\u00e7\u00e3o. Os seguintes objetivos espec\u00edficos est\u00e3o no centro do projeto:\r\n1) aumentar a consci\u00eancia do car\u00e1cter fundamental da forma\u00e7\u00e3o judici\u00e1ria para refor\u00e7ar a independ\u00eancia e a responsabiliza\u00e7\u00e3o judiciais;\r\n2) construir confian\u00e7a, legitimidade, di\u00e1logo e responsabiliza\u00e7\u00e3o do poder judicial e dos \u00e1rbitros;\r\n3) contribuir para o desenvolvimento e dissemina\u00e7\u00e3o de uma cultura judicial europeia entre grupos-alvo para al\u00e9m das fronteiras profissionais, eventualmente inspirada tamb\u00e9m pelas melhores pr\u00e1ticas de comunica\u00e7\u00e3o\/intera\u00e7\u00e3o\/coopera\u00e7\u00e3o e pelos feedbacks provenientes da sociedade civil.\r\nO projeto come\u00e7ar\u00e1 com o foco no QCR e na sua aplica\u00e7\u00e3o como fonte quintessencial de garantias para a profiss\u00e3o judici\u00e1ria, e abordar\u00e1 a quest\u00e3o mais ampla da confian\u00e7a nos sistemas jur\u00eddicos dos Estados-Membros individuais (cuja exist\u00eancia j\u00e1 foi contestada perante o TJUE). e o reconhecimento m\u00fatuo nas \u00e1reas do direito penal.\r\nO aspecto inovador do TRIIAL reside numa mudan\u00e7a de abordagem que passa de um pressuposto abstracto de independ\u00eancia judicial, imparcialidade e responsabiliza\u00e7\u00e3o como um pr\u00e9-requisito do Estado de direito para uma reconfigura\u00e7\u00e3o dos padr\u00f5es actuais da educa\u00e7\u00e3o judicial em que estes tr\u00eas termos se tornam todos parte de um processo integrado que envolva uma multiplicidade de intervenientes na aplica\u00e7\u00e3o do quadro jur\u00eddico dos direitos fundamentais da UE, em vez de objectivos distintos a abordar.\r\nAl\u00e9m disso, o projecto inclui o papel frequentemente esquecido dos \u00e1rbitros na garantia dos padr\u00f5es de julgamento justo e acesso \u00e0 justi\u00e7a, tal como consagrados no CFR. Deve sublinhar-se que os \u00e1rbitros assumiram um papel informal, mas cada vez mais robusto, na determina\u00e7\u00e3o de v\u00e1rias quest\u00f5es do direito da UE, como resultado do apoio crescente da Comiss\u00e3o Europeia (ver, por exemplo, o novo quadro regulamentar da UE para a Resolu\u00e7\u00e3o Alternativa de Lit\u00edgios (ADR) ao abrigo da Diretiva RAL 2013\/11\/UE). The standards enshrined in the CFR, and, in particular, in Article 47 on the right to an effective remedy and to a fair trial are part of a wider EU-level legal framework that guarantees the independence, impartiality and accountability of judges, and arbitrators and other legal practitioners. In addition, increasing the ability of legal practitioners, including the judiciary, to promote rule of law in their everyday work while implementing the EU fundamental rights legal framework. In doing so the Project aims to support the development of networks of knowledgeable legal practitioners working on the rule of law and democracy.
