{"id":7436,"date":"2024-12-19T13:35:24","date_gmt":"2024-12-19T13:35:24","guid":{"rendered":"https:\/\/lisbonpubliclaw.pt\/?post_type=blog&#038;p=7436"},"modified":"2024-12-19T13:35:25","modified_gmt":"2024-12-19T13:35:25","slug":"concorrencia-tribunal-de-justica-da-uniao-europeia-entende-que-a-troca-de-informacoes-entre-instituicoes-de-credito-em-portugal-pode-constituir-uma-restricao-a-concorrencia-cabendo-a-decisao-a-autor","status":"publish","type":"blog","link":"https:\/\/lisbonpubliclaw.pt\/en\/blog\/concorrencia-tribunal-de-justica-da-uniao-europeia-entende-que-a-troca-de-informacoes-entre-instituicoes-de-credito-em-portugal-pode-constituir-uma-restricao-a-concorrencia-cabendo-a-decisao-a-autor\/","title":{"rendered":"Competition: Court of Justice of the European Union understands that the exchange of information between credit institutions in Portugal may constitute a restriction on competition, with the decision being up to the national authority"},"content":{"rendered":"<p><strong>CJEU \u2013 Case C-298\/22<\/strong><\/p>\n\n\n\n<p>In a decision handed down in Case No. C-298\/22, the Court of Justice of the European Union (CJEU) ruled that the exchange of information between credit institutions in Portugal may constitute a restriction on competition.<\/p>\n\n\n\n<p>The decision is based on a case in which the Portuguese Competition Authority (AdC) imposed a fine of 225 million euros on 14 credit institutions, considering that they had violated national and EU competition law for having participated in a comprehensive reciprocal exchange of sensitive information between 2002 and 2013. In short, the AdC<em>\u201cconsidered that this exchange of information constituted a restriction of competition by object.
